A residential development on a greenfield site on the edge of an existing town.

NJL Consulting was instructed by Strategic Land Group (SLG) to act as lead planning consultant to secure outline planning permission for up to 140 dwellings at a site to the south of Henthorn Road in Clitheroe, Lancashire.

The site was greenfield, but sat opposite a site that was granted planning permission on appeal in 2012.

Challenges

Initial pre-application advice from the Council was supportive of an application, however by the time the application was due to reach planning committee Ribble Valley Borough Council believed that they could demonstrate a five-year supply of housing land.  In particular, the Council felt that Clitheroe had already delivered its fair share of development based on their emerging Local Plan.  They therefore opposed the principle of development.

Our Role

To support the planning application, NJL prepared a Planning Statement, Design and Access Statement and Energy Reduction Report in house.  We also coordinated a public consultation exercise and carried out a detailed analysis of the five-year housing land supply position.

Despite their initial support for an application, shortly before the scheme was due to be taken to planning committee, the Council decided to oppose the scheme and refused it on the basis of housing land supply issues.

Results

Although NJL submitted appeal documentation on behalf of SLG, we continued to work with the Council to see if they could be convinced to take a different view.  As the circumstances in the borough began to chance, in particular with respect to comments made by the Inspector considering Ribble Valley’s new Core Strategy, NJL were able to convince the Council that the scheme should be supported.  The application was therefore resubmitted, and planning permission secured at planning committee in November 2013.  This course of action was hugely beneficial to the client through avoiding a lengthy, expensive appeal process.
