    Supreme Court Judgment - Fully Digested

    Last week’s judgment issued by The Supreme Court, in relation to the Suffolk Coastal District Council (Appellant) v Hopkins Homes Ltd and Richborough Estates Partnership LLP v Cheshire East Borough Council (Appellant), has been causing much discussions across the country on what this will mean for residential planning applications (and appeals) in the future.

    Following briefings provided by others within the past week, NJL has digested the decision and what this will mean moving forward and set out below a summary of how this could impact upon your existing and future planning applications.

    Survival of the Fittest

    Last week it was reported that UK retail sales had taken an unexpected dip in September.  This was accompanied by claims that warmer than normal weather could be to blame, or people overspent in August so cut back for a month.  However, in addition to the speculation about it being a short term phenomenon, is the very real possibility that the reason is actually due to a dent in consumer confidence which has sprung from the uncertainties surrounding Brexit.

    On the day of the Brexit poll I attended a Seminar titled ‘Retail & Town Centres: Where next? put on by the RTPI which included a talk by Mohammed Chaudhri of Experian Decision Analytics.  His talk was about the prospects for the UK economy and the retail sector, it looked at how the economy had faired since the recession, explained why there had been a slowdown in 2016 and looked forward to a post Brexit time.  The crux of his analysis was that;

    Residential Development at Weir Road, Norwood

    On behalf of Cashco UK Ltd, NJL Consulting have submitted a full planning application to Lambeth Council, for the redevelopment of a brownfield site to provide 8 dwellings. The site is currently occupied by a cash and carry and associated storage buildings and parking areas. The cash and carry business is in the process of relocating a larger, more suitable site within Lambeth in the near future, which NJL are also advising on.

    SoS Confirmation of Leeds City Council Housing Land Supply Shortfall

    A Secretary of State (SoS) decision (8 June) has confirmed a housing land supply shortfall in Leeds – with clear implications for the consideration of future applications for residential development in the short term.

    The SoS agreed that the appeal by Miller Homes, for land at Boston Spa, should be allowed. The decision provides confirmation of the weight to be attached to Leeds Unitary Development Plan Review (LUDPR) policy N34; and draft neighbourhood plans, as well on the 5 year housing land supply position.
